1. PERMISSIONS
Paintball Promos through its Pass sales is allowed to sell products or services offered by the Field Owner. Passes will be offered to the public through online sales and event marketing. These Passes offer the customer a discount for the Field Owner’s goods and/or services as described in this Terms and Conditions and this Online Registration. Paintball Promos is allowed to sell its Passes through various channels included but not limited to: a) Daily Deal sites, b) event marketing, c) business to business means, d) Facebook store, e) Social media sales, f) Corporate or group/special event bookings via direct buy site, g)Paintball Promos App. Both Paintball Promos and the Field Owner agree to the following terms and conditions:
2. SALES NOTIFICATIONS
Paintball Promos is responsible for notifying Field Owner of marketing run dates and locations to prepare for increased traffic and phone sales.
3. EXPIRATION OF PASSES
The promotional value of each Pass shall expire approximately six months to one year from the date of purchase depending on the specific promotion. The purchase price value shall not expire. The Field Owner is aware and acknowledges that the law may require that Passes may be redeemed beyond their stated expiration dates, and Field Owner agrees to abide by applicable law presiding in their respective State/Province.
4. SALE OF PASSES
All proceeds from the sale of the Pass(es) sold on deal sites, Corporate Direct Sell site, shall be the sole property of Paintball Promos. Paintball Promos will receive $2 from each custom package sold through the app.
5. CONSIDERATION FOR MERCHANT
As consideration for the Field Owner, Field Owner will solely benefit from all sale of paintballs and/or air and any marketing campaign Paintball Promos provides to the facility. Field Owners will also benefit from Paintball Promos’ proprietary software to use the:
6. LOYALTY PROGRAM
The Field Owner has to the option to participate in the Paintball Promos, field specific Loyalty Program, Mobile Rewards at the reduced member rate of $29.99 USD per month. App is to be downloaded by Field owner. Configuration support is available at no cost through support staff at Paintball Promos.
7. DUPLICATION OF PASSES
The Field Owner agrees to not duplicate the Pass(es) program that Paintball Promos runs or to run similar deals through any deal sites directly.
8. FIELD OWNER CHANGES
The Field Owner is responsible for contacting and notifying Paintball Promos of any and all changes to their business that may affect the sale or redemption of the Pass(es). This includes but is not limited to, change of address, pricing structure, contact information, legal name and ownership.
9. PASS ACCEPTANCE
Field Owner cannot impose any additional fees, conditions, terms or charges that may contradict the terms set forth by the Pass(es). Field Owner must honor deal site rules when dealing with Pass(es). In the event that a customer brings an expired deal site voucher or Paintball Promos Pass, the Field Owner must compensate the customer with the purchased value of the deal towards the regular priced sale. Passes are valid until the expiration date. After this date, each Pass will have a value of $5.00 (five dollars) towards equipment rentals. Charges at the facility must follow pricing structure as set for in this “Terms and Conditions” and this Online Registration.

11. LIABILITY
Paintball Promos and its affiliates shall not be liable for, and shall be defended and indemnified against, for any claim brought by any customer or other person arising out of injury or death related to or arising out of activities on Field Owner’s property. In no event shall Paintball Promos be liable for any special,incidental, consequential, punitive, direct or indirect damages even had it been advised of the possibility of such damages in advance. Each facility is responsible for obtaining and maintaining it’s own liability waivers. While Paintball Promos offers a waiver service, the Field Owner is still responsible for insuring that each player has a waiver on file. If the player does not have a waiver on file, the Field Owner will make a hard copy and/or a link of the online waiver available to the player at the facility at the time of play.
12. TERMINATION:
Either party may terminate this agreement at any time by giving sixty (60) days written notice to the other Party. However any Passes that have been sold prior to termination date must be accepted and redeemed by Field Owner.
12. ENGAGEMENT:
For the consideration of working with the Paintball Promos Marketing Systems and software, Field Owner agrees to work with the Paintball Promos online Pass/ticket sales system exclusively. Should the Field Owner or Paintball Promos wish to terminate this agreement, Field Owner is then free to work with any other Pass and/or ticket sales company after the 60 days period. If the Field owner has pre-existing contracts with other pass/ticket sales companies, this is to be included in the below under Section 14 of this agreement.
